Welcome to Encore Exchange! These Seller Terms & Conditions outline the guidelines for renting a booth, displaying merchandise, and selling items through Encore Exchange. By reserving a booth or selling items through Encore Exchange, you acknowledge that you have read, understood, and agree to these terms.

Booth Rental & Booking Policy

Encore Exchange offers a limited number of weekly booth rentals. Booth reservations are confirmed once payment has been received.

Each booth rental includes one full week of selling time. Sellers are responsible for setting up, organizing, pricing, maintaining, and removing their merchandise during their rental period.

Saturday Booth Rentals

Setup: Saturday morning from 8:00 AM–10:00 AM
Selling Period: Saturday through Friday
Unsold Item Pickup: Friday evening from 7:00 PM–8:00 PM

Wednesday Booth Rentals

Setup: Wednesday morning from 8:00 AM–10:00 AM
Selling Period: Wednesday through Tuesday
Unsold Item Pickup: Tuesday evening from 7:00 PM–8:00 PM

Booth availability is limited and reservations are only guaranteed once payment has been completed.

Booth Setup, Restocking & Seller Responsibilities

Sellers are responsible for:

  • Bringing clean, ready-to-sell merchandise.

  • Pricing all items clearly.

  • Creating and maintaining an organized and attractive booth display.

  • Keeping merchandise within their assigned booth space.

  • Removing all unsold merchandise at the end of their rental period.

Sellers may restock, reorganize, and refresh their booth at any time during regular business hours throughout their rental period.

 

Encore Exchange provides the booth space and shopping environment but sellers remain responsible for the condition, pricing, and presentation of their merchandise.

Merchandise Guidelines & Pricing Requirements

Encore Exchange is a curated marketplace designed to provide customers with a clean, organized, and enjoyable shopping experience.

All merchandise must be:

  • Clean and in good condition.

  • Free from stains, excessive wear, odors, or damage.

  • Appropriate for the Encore Exchange customer experience.

  • Clearly marked with a visible price tag.

Items without a visible price tag will not be placed on the selling floor.

If a price tag becomes detached or missing, Encore Exchange will notify the seller through the contact information provided, including Instagram messaging when available.

The item will be removed from the sales floor until the seller confirms the correct price.
 

Sellers agree to either:

  • Return to Encore Exchange to retag the item, or

  • Allow Encore Exchange staff to retag the item on their behalf.
     

Encore Exchange reserves the right to remove items that are damaged, unsafe, inappropriate, counterfeit, prohibited, or do not align with store standards.

Sellers may not sell illegal items, recalled products, hazardous items, or merchandise that violates applicable laws.

Display, Merchandising & Promotional Features

Encore Exchange is committed to creating an engaging shopping experience and may make reasonable merchandising decisions throughout the rental period.

Sellers acknowledge and agree that:

  • Items may be moved from a seller’s booth to featured areas including mannequins, display tables, window displays, seasonal displays, or other promotional areas.

  • Items may be featured on Encore Exchange social media, website, or marketing materials.

  • Encore Exchange may rearrange merchandise placement to improve customer experience.

  • Featured placement does not guarantee a sale.

By selling through Encore Exchange, sellers provide permission for photos and videos of their merchandise to be used for Encore Exchange promotional purposes.

Pricing & Inventory Changes

Sellers are responsible for maintaining accurate pricing on all merchandise.

Items may not be removed, repriced, or marked down without proper updated pricing information.

If a seller would like to change the price of an item during their rental period, they must:

  • Update the price tag themselves, or

  • Notify Encore Exchange staff and receive approval before the change is made.

Encore Exchange may provide pricing suggestions to help sellers create a successful shopping experience.

Closet Renewal Policy

Booth rentals are available for renewal based on availability and store standards.

Encore Exchange reserves the right to deny closet renewal if a booth does not generate sales at least equal to the weekly booth rental cost for two consecutive rental periods.

If a seller would like to continue renting beyond their original rental period, additional weeks may be approved at the discretion of Encore Exchange based on:

  • Booth performance

  • Inventory quality

  • Customer interest

  • Overall marketplace needs

Renewal is not guaranteed and is subject to availability.

Lost, Stolen, or Damaged Items

Encore Exchange takes reasonable steps to help ensure seller inventory is organized, displayed appropriately, and protected within the store environment. However, Encore Exchange is not responsible or liable for any lost, stolen, missing, or damaged merchandise.

Sellers understand that they are displaying personal property in a shared marketplace environment and accept responsibility for the risk associated with their inventory.

 

Sales Commission & Fees

Encore Exchange operates on a commission-based selling model.

For each item sold:

  • Encore Exchange retains one-third (1/3) of the total sale revenue.

  • The seller receives two-thirds (2/3) of the total sale revenue.

Any applicable fees, including credit card processing fees or payment processing fees, will be deducted and shared proportionally between Encore Exchange and the seller based on the commission split.

Seller Payouts

Seller payouts will be processed 3–5 business days after the final selling day of the rental period.

All payouts will be issued strictly through Venmo.

Sellers are responsible for:

  • Providing accurate Venmo information.

  • Confirming Venmo details at setup.

  • Informing Encore Exchange of any changes to payment information.

Encore Exchange is not responsible for delays caused by incorrect or outdated payment information.

Cancellation & Rescheduling Policy

Encore Exchange does not offer refunds on booth rentals. However, sellers may cancel or reschedule their reservation if requested at least 48 hours before the rental period begins. Rescheduling requests are subject to booth availability. No-shows or cancellations made less than 48 hours before the reservation begins may result in forfeiting the rental fee.

Unsold Item Pickup Policy

Sellers are responsible for removing all unsold merchandise during the scheduled pickup window.

If a seller cannot pick up items during the designated time, they must contact Encore Exchange.

Staff assistance may be available for a $15 assistance fee, which may include removing, organizing, and holding remaining merchandise.

Sellers will have two (2) days after the scheduled pickup time to collect remaining merchandise or make arrangements with Encore Exchange.

If items have not been picked up and the seller has not contacted Encore Exchange within the two-day timeframe, remaining merchandise may be considered abandoned and may be donated.

Weather, Emergencies & Store Closures

Encore Exchange will make reasonable efforts to remain open during normal business operations.

In circumstances outside of our control, including:

  • Severe weather

  • Unsafe roads due to ice or flooding

  • Power outages affecting store operations

  • Government-required closures

  • Other emergency situations

Encore Exchange may temporarily close or adjust operations.

If Encore Exchange is unable to operate for the entire scheduled selling period due to an emergency closure, a refund or credit may be issued for the affected rental period. Weather conditions that do not prevent store operations will not qualify for refunds.

Seller Requirements & Responsibilities

By participating as a seller, you confirm that:

  • You are at least 18 years old or have appropriate permission from a parent or legal guardian.

  • You legally own the items you are selling and have the right to sell them.

  • Your merchandise does not violate any laws, copyrights, trademarks, or ownership rights.

  • You are responsible for any taxes related to your sales.

Encore Exchange is not responsible for individual seller tax reporting requirements.

Rental Pricing Changes

Encore Exchange reserves the right to update booth rental pricing, fees, or services at any time. Any pricing changes will be communicated to sellers and will apply to future reservations and transactions.

General Terms & Conditions

Governing Law

These Terms & Conditions shall be governed by and construed in accordance with the laws of the state in which Encore Exchange operates.

 

Entire Agreement

These Terms & Conditions constitute the complete agreement between the seller and Encore Exchange regarding booth rentals, merchandise sales, and related services. No other oral or written agreements shall be binding unless executed in writing and signed by both parties.

Modifications

Encore Exchange reserves the right to update or modify these Terms & Conditions at any time. Changes will be communicated to sellers and will apply to future transactions and reservations.

Seller Acknowledgment

By reserving a booth and selling items through Encore Exchange, you acknowledge that you have read, understood, and accepted these Terms & Conditions. You agree to follow all Encore Exchange policies and guidelines and understand that these terms are designed to create a safe, organized, and enjoyable marketplace for sellers and shoppers.
